摘要
食品安全法上的"公众"由不同职业、社会意识水平人群构成,我国现行立法在设定法律主体地位时缺乏对其进行类型化甄别,形成公众监督制度存在主体角色道德化、功能边缘化、权利行使附从化的不足。出于改善公众与监管者在法益上结盟的考虑,应当重新审视我国食品安全形势对公众的制度期待,推动公众监督权的实在化,完善公众与监管者、公众与经营者间食品安全法律关系的建构模式。
The difference among public as legal subjects,which consist of groups in different occupations and with different social morality,has been ignored in our legal system,which causes a big problem in the public supervision on food safety. To strength the legal interest alliance between the public and the regulator,we should renew the view on legal expectations for the public concerning food safety situation,make public supervision rights substantial and improve the legal relation structure between the public and the business.
