茶文化产业知识产权保护若干法律问题探讨——以闽茶文化创意产业为例

Several legal issues about intellectual property right protection in the tea culture industry——Taking Fujian tea culture creative industry as a case

阐述传统文化产业的特点,提出茶文化创意产业的产业形态、知识产权保护的正当性和现实需求,重点探讨现行著作权、商标权、专利权及商业秘密权对茶文化创意产业的保护模式,分析存在问题,并提出完善立法建议。

Characteristics of traditional cultural industries are illustrated, morphology of tea culture creative industry is described, justice of intellectual property fight protection and realistic demand for it are analyzed, in particular, the protection modes of copy- right, trademark right, patent right and trade secret right on tea culture creative industry are explored. Accordingly the improvement of legislation is proposed in view of the current status.
