中药专利保护与商业秘密保护的思考

Consideration on Patent Protection and Trade Secret Protection of Traditional Chinese Medicine

专利制度是知识产权体系的核心,但是源自西方的专利制度在我国传统中药保护中却面临着诸多困境,而这些问题不是为中药增设特殊审查标准或是降低专利审查标准所能解决的。与专利制度相比,商业秘密在中药领域具有一定的优势,应协调其与专利制度的关系,更新过度倚重专利的理念,以完善中药知识产权保护体系。

The patent system is the core of intellectual property protection system.But as a product of the west, the patent system is faced with many difficulties in the protection of Traditional Chinese Medicine （ TCM） in our country, and these problems cannot be solved by creating a special standard of review or reducing patent examination standards.Compared with the patent system,the trade secret protection has certain ad-vantages in the field of medicine to improve the whole intellectual property protection system of TCM while coordinating with the patent system and updating the concept of excessive reliance on patent.
