摘要
目的:基于公众诉求与信息提供者双向视角,分析"依申请公开制度"与"卫生行政许可类政府信息"需求利用特征与政府作为情况。方法:定量研究采用整群抽样的方法,对上海市2009-2012年356份依申请公开卷宗进行描述性分析;定性研究为组织15名信息公开受理窗口工作人员进行小组访谈。结果:信息提供的便捷性和可及性能满足申请人的需求;尚无"不予公开"的情况。部分回复内容与语言直接引用法条因过于专业、抽象、晦涩,导致回复的社会接受度降低。结论:信息公开立法的局限性易引起理解的分歧,应尽快通过立法解释或司法解释等方式,对政府信息的概念与范围进行更加详细的界定,以减少分歧;直接援引法律条文回复时应增加更为通俗的解释。
Objective: This paper focused on Being Made Known to The Public upon Applications and Open Health Administrative License Information, analyzed the behavior characteristics of public demand and government action.Methods:A cluster sampling was applied to select all 356 files of applications during 2009-2012, and there was a group interview of 15 staff members working in government organs.Results:Forms of provision according to application were timely and convenient, could satisfy the basic needs of public demand.But some content and language of reply directly quoting original legal text were abstract and obscurity decreased the satisfactory of applicants.Conclusion:The disadvantages of its indefinable languages of the legislation on Open Government Information caused ambiguity .Definitions and scope of Government Information should be more clearly defined by legislative explanation and judicial explanations.When directly quoting original legal text to reply, earthliness languages should be added in order to convenience-for-people.
