嫖宿幼女罪指明知是不满14周岁的幼女而与之发生性关系的行为的犯罪。其设立目的主要是保护未满14周岁幼女的身心健康。其目的是好的,但具体到实践中,出现了很多问题,如嫖宿幼女罪有违道德伦理;有违法律的平等价值观;与强奸罪相混淆,造成逻辑混乱等等。另外,成立"嫖宿幼女罪"有个前提,即:在与幼女发生性关系时"知道"对方为幼女,这会为确定成立"嫖宿幼女罪"增加难度,最终以无罪逃脱法律责任。嫖宿幼女罪存在种种弊端,嫖宿幼女罪已失去其存在的价值和必要性,应将其废除。
