关于我国“空心村”形成原因的法律研究

Legal Research on Rural Hollowing in China

"空心村"问题已然成为了许多学科的共同问题,当今各学界对于该问题的研究者主要包括地理学、社会学、经济学的研究同仁,鲜有法学者对此研究,但"空心村"问题又切实涉及到许多法律问题,因而成为法学界无法回避的问题之一。在现有研究基础上提出综合性的"空心村"概念之后,分析"空心村"的形成原因,即宏观角度是因为立法不完善及执法不严格,微观上是因为村民法制观念落后及旧观念无法剔除等因素。

Rural hollowing is one of the common issues researched from various approaches, which involves geography, sociology, economics, but rarely law. Rural hollowing practically relates to legal issues and is una- voidable in legal field. The article summarizes the concept of rural hollowing based on previous studies. As the first step of rural hollowing study in the legal field, the present study analyzes the causes of rural hollowing in China. On the macro perspective, it includes imperfect legislation and loose law-enforcement. On the other hand, on the microscopic perspective, it studies other factors such as the villagers＇ lack of legal sense. To fill the vacancy, the article makes the analysis and summary on the rural hollowing in legal field.
