环境伦理的嬗变与环境刑法的法益

Evolution of Environmental Ethics and Legal Interest of Environmental Criminal Law

环境刑法的法益是环境伦理的现实化,环境伦理思潮的变动必然会影响环境法律,从而引起环境刑法法益的变动。围绕着如何保护环境,各种环境伦理学流派提出了各自的观点,迄今为止,人类中心主义伦理学、生态中心主义伦理学、人类·生态中心主义伦理学先后登场并成为环境保护的重要指导思想,与此相对应,环境刑法的法益也发生了相应的变化。

The legal interest of environmental criminal law is the way to realize environmental ethics. The change of environmental ethics is bound to influence environmental law, which will lead to the change of the le- gal interest of environmental criminal law. As to how to protect environment, all environmental ethics schools put forward their own viewpoints. So far, anthropocentric ethics, ecocentric ethics, human and ecocentrism have emerged and become the important guiding principles for environmental ethics. Therefore, legal interest of environmental criminal law has also changed correspondingly.
