摘要
不具有独立性的司法不是真正的司法,失去制约的司法会偏离司法公正。人大应当在尊重法院独立行使审判权的前提下监督法院工作,寻求司法独立与权力制约的动态平衡。个案监督既不具有合法性也不具有合理性,人大必须杜绝各种形式的个案监督,将对法院工作的监督重点集中到非司法判断的工作事项中,集中到对法院规范性文件、司法人员职业操守和司法经费等事项的监督中来。人大监督法院要区别于对政府和检察院的监督,有变通地运用审议工作报告和质询等方式方法。
Justice without independence is not real justice, and justice without restriction 1s far from judicial impartiality. People' s Congress shall supervise courts under the conditions of respecting the independent execution of judicial power by courts so as to strike a dynamic balance between judicial independence and power restriction. The case -by -case supervision is neither lawful nor reasonable, so People' s Congress, when supervising courts, shall avoid all kinds of case- by- case supervision, and focus on non -judicial matters, such as normative documents issued by courts, legal ethics of judicial personnel, and judicial funds. The congress supervision on courts shall be different from its supervision on administrative governments and procuratorates, by way of providing flexibility when examining working reports submitted by courts and making inquiries upon courts.
