Judicial Organization Reform in China Based on Its Constitution——Comparison between the Mainland and SARs

我国目前司法组织改革的宪法规制相比改革实践与形势来说稍显滞后。对比特别行政区基本法关于司法组织的规定,不难发现内地现行司法组织宪法规定的漏洞,司法组织改革是系统工程的运作,需要从定名定性、司法人员规制、司法(组织)协助外向化和自新机制打造的角度,构建司法组织改革的多重宪法依托。

In China the constitutional regulation on the present judicial organization reform seems lags behind the reform practice and situation. If we compare the provisions of the judicial organization stipulated in the basic law of SARs, it is not difficult to find the loopholes in the present constitutional provisions of the judicial organization. The judicial organization reform is the operation of systematical construction. A multilevel constitution dependence should be constructed for the judicial organizational reform by confirming the name and character of the judiciary, regulating the judicial persons, making the judicial （ organization ） assistance outgoing and setting up the self - changing system.
