举报人行为动机的伦理正义性辨析 被引量:4

摘要 举报人的行为动机本身不应该参杂到错误事件的调查过程当中,或者只有当存在诬告或者需要证明举报人身份的时候,行为动机才会被作为案源线索纳入接报机关的调查视野,但这并不能妨碍媒体促成社会对于举报人行为动机的关注。举报信息的保密性进一步逼迫媒体引领公众,将举报动机作为探究举报线索可靠性的唯一证明,某些时候甚至超越了对于事件本身的关注,这种迫于职业生存的引领同时也干扰举报人关于行为伦理正义性的判断,降低举报意愿向举报行为实施的转化效率。文章从自我伦理正义达成、忠诚意愿表达以及职业伦理坚守三个角度分析举报人的行为动机,力图在国家法律的认定正义之外,为举报人寻找行为伦理正义的证明。 The behavior motivation of the whistleblowers should not be involved into the investigation process of error events. The motivation of the whistleblowers should not be included in the survey as a source case clue to the authorities unless there exists false accusation or necessity of proving the whistleblower's identity. But this does not prevent the media from paying attention to the whistleblowers. Confidentiality of information forces the media into leading the public, which makes the reported motivation as the sole clue of reliability. Sometimes the concem for the motivation of the whistleblowers is even greater than that for the event itself. The guide of the occupation surviv- al pressure meanwhile interferes with the judgment of the whistleblowers' behavior ethical justice, and lowers the conversion efficiency from report willingness to report acts performance. This article analyzes the whistleblowers' behavior motivation from the ethics of self-righteousness, the expression of loyalty and willingness to adhere to the professional ethics, and tries to find the ethical justice proof of the whistleblowers' behavior in addition to the na- tional law identify justice.
