The Development of the Management System for Psychotics in Ancient China

本文站在法制史和社会史的立场上,通过梳理自商末到清,有关精神病人管理制度,来考证并分析此管理制度发展的历史沿革。文章透过保安性非自愿住院制度,揭示了清代对疯病杀人的防治与报官锁锢制度的合理性与其严重弊端;进而透过追溯光绪年间的《附设疯人院简章》,为当代中国《精神卫生法》的建立找到了相应的历史渊源。

This work conducted the literature review of the management system for psychotics between the late Shang Dynasty and Qing Dynasty.The history of how the management systems were established,developed and changed in terms of legislation in ancient China was examined and analyzed.Self-referral hospital admission due to safety concerns revealed the rationality and the serious drawbacks of the measures taken by government to prevent psychotics from killing and locking them away caused in ancient China. ' A Guide to the Affiliated Bedlam',established during the reign of the emperor Guang Xu of the Qing Dynasty,laid the historical foundation for ' Mental Health Act' in China.
