从权利正当性视角探析个人信息权利的属性

On Property of Personal Information Right from the Perspective of Right Legitimacy

伴随着社会主体物质生活、道德观念以及心理需求的变化,一种新的法权要求——个人信息权利呼之欲出。个人信息权利的根本价值在于保护个人认为应当保守的信息利益,保卫权利主体独立、自主的人格以及在此意义上的精神安宁。捍卫财产利益的个人信息权利不可等同于财产权,恰恰由于其完备的人格权特质以及法理根源,个人信息权利应该属于一种新型的具体人格权。

With the change of material life, moral idea, and psychological need of the social subjects, a new legal right requirement-personal information right is ready to come out. The fundamental values of personal information right are to protect the information interests which a person thinks should be held, to defend the independence and independent personality of the right subjects, and the mental peace in this sense. Personal information right to defend the property interests can not be equated with property rights ; the complete traits of personality right and the legal origin is the only reason that personal information right should belong to a new type of concrete personality right.
