思想力量、分析工具和批判武器——论作为侵权法哲学的“亚氏正义观”

The Power of Thought, Analysis Tools and Criticism-- On ＂Aristotle＇s concept of justice＂ Regarded as Philosophy of Tort Law

“亚氏正义观”，即亚里士多德把正义分为分配正义、矫正正义和威慑正义的观点，至今仍是英美侵权法的哲学基础，对于在侵权法领域实现立良法、行善治具有重要的方法论意义。为此，介绍医疗过失责任法在英美法系国家两次改革的动因和发展脉络，分析“亚氏正义观”对侵权法改革的推动作用，并以疑难的医疗纠纷案为例，展示“亚氏正义观”在英国审判实践中的应用。主张“亚氏正义观”对我国在侵权法领域追求制度正义和司法正义，具有同样重要的价值。

＂Aristotleg concept of justice＂, namely, Aristotleg thought that di- vides justice into distributive justice, corrective justice and deterrent justice, is still the philosophical foundation of the Anglo - American tort law, which has im-portant methodological Significance for making good law and practicing good gov- ernance in the area of tort law. Therefore, the paper introduces the reasons and development context of the two legal reform of the law of medical negligence in the common law countries, analyses the impetus of Aristotle＇s concept of justice for tort reform, and shows the application of Aristotle＇s concept of justice in the UK＇ s judi- cial practice with difficult case of medical disputes, and advocating Aristotle＇s con- cept of justice has the same important value for China in pursuing system justice and judicial justice in the field of tort law.
