论中国死刑制度的若干问题

Some Issues about Death Penalty in China

文章从考察死刑的历史出发,结合一些案例进行分析,论述了我国死刑的执行程序、判处死刑的标准等问题。在此基础上,提出了减少死刑罪名的具体方法,即将死刑罪名集中在剥夺他人生命的案件中;对于没有杀害他人生命的行为人,尽量不判处死刑。这样,既可以保持死刑的威慑力,又可以最大限度减少死刑罪名的适用,最终彻底废除死刑。

Beginning with the history of death penalty, this article elaborates many issues of Chinese death penalty in criminal cases,such as: execution procedure, criteria of death penalty. On this basis, the article puts forward the specific method of reducing crimes subject to death penalty. That is, the death penalty charge should be the cases which deprive others 'life. For those doers who do not kill others,they should not be sentenced to death. Therefore, the deterrent force can be maintained and the application of death penalty charges can be reduced to the limit. And finally the death penalty can be abolished completely.
