横向并购反竞争效应的实证研究评述

The New Development of the Empirical Research on the Anti-competition Effect of Horizontal Mergers

对横向并购反垄断规制的实证研究方法与结论进行了梳理和评述。认为衡量横向并购案件反竞争效应的方法日益成熟,这主要得益于基于市场结构的评估和基于并购模拟的实证研究的不断发展。我国对并购的反垄断审查很少从单边效应和协调效应角度出发,更多是从市场结构的角度展开审查,目前迫切需要借鉴国外分析并购案件反竞争效应的理论和方法进行并购个案的反竞争效应分析。

This paper surveyed the recent literature about the Horizontal Merger Antitrust Regulation and re- viewed the empirical research methods and conclusions. Methods employed in antitrust enforcement to measure anti - competitive effects of horizontal merger cases have become more sophisticated, which is attributed to the continuous development of empirical research based on market structural assessment and merger simulation. China＇s antitrust control of mergers rarely analyzes unilateral effects and coordinated effects of merger cases but relies heavily on the review of market structure. There is an urgent need to learn new theories and new methods from foreign countries＇ antitrust practice.
