舆论监督权的法理悖论与消解

The Legal Paradox in the Power of “Yu Lun Jian Du”and Its Deconstruction

舆论监督权是中国语境中特有的概念。但从宪法条文的语义来看,它存在着一系列法理上的悖论。本文运用宪法学的目的解释方法,发现了舆论监督权概念在中国宪法语境的真实含义,进而祛除了其享有主体和对象在法理上的悖论。不仅如此,为了进一步祛除隐藏于舆论监督权运作机制中的悖论,本文又用商谈理论重构了它的法理基础,并将其规范性含义确认为"协商型治权"。本文关于舆论监督权含义的重构,不仅在学理上使其实现了逻辑自洽,而且为舆论监督实践的法治化保障提供了全新思路。

The power of ＂Yu Lun Jian Du＂ is the unique concept in the Chinese context. How- ever, from the semantic perspective of the constitutional text, it faces a series of legal paradox. This paper has found the true meaning of the power of ＂Yu Lun Jian Du＂ in the Chinese constitutional context, using Constitutional objective interpretation method. Not only that, in order to eliminate in- herent a legal paradox hidden in the concept of the power of ＂Yu Lun Jian Du＂, this paper also used discourse theory restructure its legal basis, and then recognize its normative implications as ＂The power of deliberative governance＂. The conclusion in this paper has not only meet the self consistent on the concept of the power of ＂Yu Lun Jian Du＂ in logic, but also provides a new idea for the system guarantee of the practice by ＂Yu Lun Jian Du＂.
