社会团体设立登记程序中的问题及其完善——以异地商会设立登记程序为讨论中心

The Issues of the Social Organizations Establishing Procedure and its Perfection: take the Establishing Procedure of Alien Chamber of Commerce as an Example

社会团体的登记程序分为申请筹备程序和申请登记程序的规范,旨在发挥政府的监督职能,在社会团体准入阶段加强管理,但这并不符合改革的要求,两个程序大量重叠,增加了社会团体的设立成本,而且给有关政府管理人员提供了寻租机会,应该予以取消,规定统一的登记程序。成立异地商会必须得到原籍地人民政府相关部门的同意,并出具支持函件这一要求也应该取消。社会团体的章程和登记必要的记载事项目前在异地商会关于登记管理的地方规范性文件中几乎没有涉及,应予以完善统一。

The establishing procedure of ~cial organizations is divided into ＂applying for preparation＂ and ＂applying for establishing＂ , and it intends to allow governments monitor the procedure of establishing. However, this is not complying with the requirements of reformation. The two procedures are overlapped and increase the difficulty of establishing social organizations; more importantly, it gives the official opportunity to go to corrupt. So, these two procedures should be integrated. At present, to establish an Alien Chamber of Commerce, people must get permission of original government, and this requirement should also be abolished. The items that the charter and register book must record have not been stipulated in the regulations of Alien Chamber of Commerce, and, undoubtedly, this should be perfected.
