域名与商标及其法律保护思考

Domain Names,Trade Marks and Their Legal Protection

随着互连网的发展，域名与商标之间的法律关系及法律保护问题成为司法实践的焦点，域名抢注行为是一种商标侵权行为，但同时应当肯定，域名权也应是一项独立的民事权利，域名权权益应受到充分保护。我国应积极借鉴国际社会域名管理的立法经验以及域名争端解决机制的规则，完善我国的域名注册及域名管理法规，使其更具科学化、法制化、规范化。

With the development of Internet,the legal relationship between domain names and trade marks and their legal protection have become the focus of judicatory practice.The rush registration of domain names is a violation of trade marks.It needs to be pointed out,however,that the right to domain names is also an independent civil right and should be duly protected.This paper suggests that China should use for reference the international legislative experiences concerning domain name administration and relevant rules to settle domain name disputes.In this way,China′s laws and regulations concerning domain name registration and administration can be improved towards legalization and standardization.
