摘要
"封芝琴婚姻纠纷案"是20世纪40年代发生于陕甘宁边区的一桩普通案件。经过马锡五的审判,受到了边区政府的赞许和民众的一致认可。随后,该事件成为艺术人物"刘巧儿"的原型,经边区新闻媒体与文艺界的宣传,刘巧儿这个小人物的地方性故事成为一个时代"反抗封建买卖婚姻、争取婚姻自主"的典型代表。但"封芝琴事件"与演变成"刘巧儿故事"的发生、发展以及变化过程却呈现出民间社会、官方以及政治、文艺与民众既有矛盾冲突,又有互动和趋向一致的多样性。
"Marriage Dispute of Feng Zhiqin"was a common case in Huachi County of Shaanxi-Gansu-Ningxia Border Region in 1940 s. Being judged by Ma Xiwu,the judicial outcome was approved and praised by the Border Regional Government and the local people. Subsequently,the event became the art prototype of Liu Qiaoer and the story of the little local woman grew into the typical representative of "revolting feudalism mercenary marriage and striving for independent marriage"of that era through propagandizing by the news media and the circle of literature and art of the border government. The origin,the development,and the change of "the Case of Feng Zhiqin"into"the Story of Liu Qiaoer"show that there are conflicts as well as interactions and consistencies not only between the civil society and the official but also among the politics,the literature,and the public.
