完善我国网络信息监管法律政策国际环境与产业需求分析

Analysis on Demands for Improvement of the Chinese Laws &Policies on Online Information Regulation from International Environments and the Chinese Industries

除了所面临的巨大外交压力之外,我国的网络信息监管问题还面临着国外日益强化网络信息监管的法律制定与修订、日益注重网络信息监管政策制定的国际环境。通过指出国内网络产业的规模扩张、网络服务提供者监管责任的模糊、网络信息监管执法措施不规范等现状,并阐述国内相关法律存在规范层级低、被监管信息类别冲突、过分强调管制而漠视网络主体权利的保护、部分地方法规明显违背上位法规定等立法缺陷,以及多头监管体系缺乏协调、监管机关偏离公共利益导向追求部门利益、缺乏系统性的运动式执法措施等监管政策缺陷,表明国内网络产业对完善我国网络信息监管法律政策的客观需求,强调全面清理并完善我国网络信息监管法律与政策的紧迫性与必要性。

In addition to facing tremendous diplomatic pressures, This paper analyzes the international environments, i.e. foreign countries have strengthened increasingly enactments and revisions of their laws on online information regulatory activi- ties, issued many policies on them, which are faced by the Chinese laws and policies on the online information regulation. It indicates urgent demands from the domestic online industries for improving the related Chinese laws and policies by sorting out such statuses as scale expansion of domestic online industries, ambiguity in ISP＇s regulative liabilities, non-standard enforce- ment measures, and by elaborating such flaws in laws and policies as low legal level of norms, conflicts between the regula- ted information categories in laws, overemphasis on regulation rather than protection of online participants＇ rights, states＇ regulations contraventions with higher level laws, multiagency regulative system, regulative agencies＇ pursuit of their own sectional interests, and the intermittent enforcement activities. It emphasizes the urgency and necessity of comprehensively checking up and improving the related Chinese laws and policies.
