System Research on Civilian Personnel between Chinese and Foreign Police: Comparison and Reference

摘要 我国公安实务部门和理论界对于警察文职制度的理解存在模糊化倾向,甚至把辅警、工勤人员和保安员这些本不属于文职体系的警务辅助人员也划入其中。观察西方国家警察文职制度的发展脉络,文职人员的岗位设置基本以"非执法"为原则,另外根据社会的发展及情势的变化进行适当的调整。目前,我国公安机关并没有真正形成统一的警察文职人员体系,而现实警力严重不足又使基层公安机关离不开文职人员的辅助工作。因此,我们应借鉴并综合西方国家和我国香港特区的警务模式构建警察文职体系,在非执法岗位以文职人员的用工形式建立规范化、职业化的警察文职制度。 The practice and theory of public security organs tend to have a blur understanding towards the system of civilian police by putting the auxiliary police, workers and security officer into civilian police. Western civilian police system sets "Non-enforcement" as the principle and makes appropriate adjustments according to the situation of social development and changes. So far, China's public security organs haven't really formed a unified civilian police system, while the grassroots level public security organs are in serious shortage of police officers which make them inseparable from civilian auxiliary work. Therefore, a standardized, professional civilian police system in the form of non-enforcement is to be constructed by referring to and integrating policing model from western countries and Hong Kong SAR.
