我国城市交通环境绿色发展的法治化路径研究

Research on the Legal Path of Green Development of Our City Traffic Environment

如何实现城市交通环境的绿色可持续发展,是步入汽车社会后摆在我们面前的现实问题。实践表明,单靠技术手段无法解决这一难题,而跳出技术思路,运用法治思维和法治方式应对,是解决问题的有效途径:应通过完善交通领域相关立法,奠定城市交通环境绿色发展的法治基础;通过转变交通行政执法体制和执法方式实现对城市交通环境的高效治理,从而达到交通拥堵得以控制和缓解、由尾气排放引发的空气污染状况得以改善、交通安全事故发生率大幅降低的效果,最终实现我国城市交通环境的绿色和可持续发展。

It is a realistic problem to achieve the green and sustainable development of city traffic environment in automobile society. The practice shows that we can not solve this problem by technical means alone. If we use the rule of law and the legal thinking of ways to deal with this problem, we＇ll find it is very effective. We should lay the law basis of green development of city traffic environment by improve the relevant legislation of traffic field, We should realize the effective governance of the city traffic environment by changing the system and the mode of traffic administrative law enforcement. Our goal is to achieve the following objectives： traffic congestion can be alleviated, air pollution situation will be improved, the traffic accident rate will be greatly reduced . We will eventually realize the green and sustainable development of urban traffic environment in our country.
