摘要
商标法是保障市场经济健康发展的重要法律。随着形势变化,我国《商标法》滞后性日益明显。2013年8月第三次修正的《商标法》简化了商标注册申请程序,便利了申请人及时获得商标注册,规范了商标使用行为,提高了对商标专用权的保护力度了,强化了商标法律制度规范市场公平竞争秩序的功能和作用,同时注重协调和平衡商标法律关系,实现了私权保护和维护公共利益的有效平衡。我国修改后的《商标法》是一部兼具本体化、国际化和现代化特色的知识产权法。它的实施必将对中国市场经济发展发挥极为重要的作用。同时,囿于多方面限制,该法仍然存在若干值得进一步完善的问题,需要加以研究并提出对策。
The trademark law is an important law to protect the healthy development of the market economy.As the situation changes,China's Trademark Law lags behind increasingly.The Trademark Law,amended on August 2013 for the third time,simplifies the application for trademark registration,makes it convenient for the applicants to acquire the trademark registration timely,regulates the use of the trademark,improves the protection of the exclusive rights to exploit a trademark and strengthens the function and role of trademark legal system in the market order of fair competition.At the same time,it also focuses on coordination and balance betw een the legal relationship of trademark and achieves an effective balance betw een the protection of private rights and the maintenance of public interests.The amended China's Trademark Law is an intellectual property law w ith the characteristics of ontology,internationalization and modernization.It w ill play an important role in the development of Chinese market economy.Meanw hile,limited to many aspects,it still exists several issues deserving further improved,to be w orthy of study and reflection.
