集体建设用地流转问题研究——以农民权益保护为视角

On Transfer Problems in Rural Collective Construction Land from Perspective of Farmers' Rights and Interests' Protection

集体建设用地使用权的流转是土地制度改革的一个重要内容,流转过程中农民权益的保护受到中央越来越多的关注。我国广东、河北、南京等地虽已通过地方规章对此作出探索性创新,但欠缺统一的法律依据和规范的制度支撑,农民在流转过程中的权益仍得不到切实保障。为解决这一问题,应全面解读各地流转管理办法,遵循农民权利赋予、权利行使和权利保障的逻辑顺序,以集体建设用地使用权流转的立法前提、制度规范和后续保障为核心内容,分析集体建设用地使用权流转现存问题并提出完善路径,以保护农民的合法权利。

The circulation of rights to use collective construction land is important in the legal system of land reform. Some prov-inces or cities like Guangdong have made explorative innovation through local regulations, but the lack of unified legal basis and normative regime support fall to effectively protect farmers’rights and interests in the circulation. To solve the problem, the local regulations of circulation should be understood completely. The current problems in circulation of rights to use collective construc-tion land can be analyzed and solved to protect farmers’rights and interests in the logical order of conferral of rights, exercise of rights, protection of rights, the core content of which is legislative premise, institutional standard and subsequent protection.
