摘要
2006年1月1日施行的《公务员法》对我国公务员人事制度法治化进程具有重要意义。但是,在当前政治实践中,公务员人事制度却主要由中国共产党党内法规规定。党内法规是否可以具有国家法律效力,是一个两难问题,导致我国公务员人事制度法治化进程的滞缓,更不利于法治国家战略目标的早日实现。党规与国法相结合,是中国特色国家公务员制度法治化的基本取向。
It is important to the legalization process of our personnel system on civil servants that the " Civil Servant Law" has been enforced from January 1,2006. However, in current political practice, the provisions of the personnel system on civil serv- ants are mainly composed of the inner regulations of the Chinese Communist Party. Whether the inner regulations of the Chinese Communist Party can have legal effect is a dilemma question. This causes the legalization process of our personnel system on civil servants developing slowly and is even not conducive to the early realization of the national legal strategic goals. Combining the national laws with regulations of the Chinese Communist Party is the basic orientation of legalization of our civil service system with Chinese characteristics.
