摘要
国家治理现代化是国家治理模式变迁过程中的产物,从本质上讲,国家治理现代化是一个开放的进程,理应包含国家与社会、个人之间的"合作"。行政法理论中"交往行为"的渗透,加之"和"传统文化的传承,共同展现"合作"的现代之意。作为"合作"的实然反馈,行政协商概念的提出是对现实与文化的双重回应,而经历过功能、形式与适用范围拷问的行政协商制度,具备预防纠纷的功能,符合"合作型谈判"的形式要件,同时可在部分行政活动中针对性适用,更具建构的可行性。
State governance modernization is the outcome of shifting state governance .In essence , state governance modernization should be an open process with the Cooperation between the state ,the society and individuals . T he infiltration of Communication Behav iors into administrative law and the traditional culture of H armony show the meaning of Cooperation together . As the reflection of Cooperation in practice ,administrative negotiation system responds to the reality and culture .Under the torture of function ,form and range ,this kind of system has the function of dispute prevention and conforms to the important condition of form in the Cooperative Negotiation ,and it can be used in some administrative activities and will be more feasible to be constructed .
