益阳市土地信托流转风险防控机制建设研究

Research on the Improvement of Risk Prevention and Control Mechanism with Regard to the Circulation of Land Trust in the City of Yiyang, Henan Province

湖南省益阳市土地信托流转机制主要有搭建农村土地信托流转平台、开展农用地确权颁证登记、整合涉农资金。流转风险主要有土地信托流转租金拖欠风险、用途管制风险、流转定价风险、征地增值收益分配风险。湖南省益阳市土地信托流转风险防范措施:(1)建立流转租金预付机制;(2)组建村级耕地保护协会;(3)创新农村土地信托流转租金形成机制;(4)明确征地中农用地增值收益分配,按照"谁投资,谁受益"的原则确定农用地设施补偿费。

This paper introduces the circulation mechanisms of land trusts in the city ofYiyang, Hunan province. These mechanisms include： building the platform for rural land trust circulation, carrying out the right certification and registration of agricultural land, integrating capital concerning agriculture. At the same time, this paper analyzes the transfer risks such as rent arrears risk, use control risk, transfer pricing risk, and distribution of incremental land value arising from land expropriation. In response to this, this paper offers some risk prevention measures. These measures lay emphasis on the following： establishing a mechanism for paying the rent of circulation in advance; organizing village-level cultivated land protection association; innovating the rent forming mechanism for rural land trust circulation; making agricultural land value-added income distribution in the land -expropriation clear; determining the compensation for agricultural facilities in line with the principle of ＂those who make investment get benefits＂.
