摘要
在取消市场进入审批后,行政机关可以运用黑名单制度来对市场主体进行监管,将列入黑名单的市场主体进行公布、重点监管、资格限制甚至逐出市场。黑名单制度是失信惩戒机制,其在法律性质上是行政处罚行为。目前,我国的黑名单制度依然存在缺陷,行政机关实施黑名单制度缺乏法律依据和程序失范问题,我国的征信体系尚不成熟以致联动机制难以实施。完善黑名单制度需要有法可依,构建全国性的公共联合征信体系以保证联动机制的实施,同时要求行政机关加强自我规制与转变执法观念。
After cancelling the approval, administrative organs may use the blacklist system to regulate the market: publishing the blacklist of market, key regulatory, qualification and even out of the market. Blacklist system is dishonesty disciplinary mechanism and the act of administrative punishment in legal nature. At present, the defects of our country's blacklist system still exist , administrative organs implement the blacklist system to regulate the lack of legal basis, procedures anomie, and China's credit system is not mature so that the linkage mechanism is difficult to implement. The implementation of the law of the blacklist system, public joint credit system may ensure the implementation of the linkage mechanism. At the same time the, executive authorities strengthen self regulation and change the concept of law enforcement.
