摘要
建设工程施工中对受害人赔偿的情形极为复杂。对建设工程施工单位与受害人之间关系进行类型化分析,是就受害人人身损害赔偿问题进行路径选择的前提。在建设工程施工单位与受害人之间存在合法用工关系的情形下,工伤保险赔偿请求权和人身损害赔偿请求权,在权利竞合方面采"兼得模式",在赔偿数额方面采"补充模式";在二者之间存在非法用工关系的情形下,受害人的人身损害赔偿问题,适用《非法用工单位伤亡人员的一次性赔偿办法》的规定;在二者之间不存在用工关系的情形下,受害人的人身损害赔偿问题,适用民事侵权损害赔偿的相关规定。
It is a complex phenomenon to compensate the victims in the project construction. The analysis of the relationship between the victims and the construction unit is the premise for the victims to choose the way of compensation. When there is a legal relationship between the victim and the construction unit, the "double model" should be used in the struggle of fights and the "complementary model" should be used when deciding the amount of compensation. If there is an illegal relationship between both sides, they should resort to One-time Compensation for Casualties in Illegal Labor Units when it comes to the problems of compensation. While, if there is no labor relationship between them, they should resort to the relevant provisions of civil tort damages when it comes to the problems of compensation.
