摘要
与社会科学其他学科相类似,大数据对法律实践和法学研究的影响也开始逐渐显现,但进行的相关讨论较少。文本试图从一个广义的角度讨论大数据和法律制度与运作之间的关系,即包括了立法、司法、行政执法、法律服务业和法学研究等领域,考察前者对后两者可能的影响,以及其中可能蕴含的一些问题,从而迫使我们反思法律实践和法学本身的特性。
Similar to other disciplines of study in social science, the effect of mega data on law practice and research inscience of law begins to he shown gradually but fewer relevant discussions are made. The essay writer attempts to discuss therelation between mega data and legal system and operation, including legislature, justice, executive enforcement, law serviceand research in science of law etc. The writer also surveys the likely effect of the former on the latter and some problemscontained in it so that we might be forced to reflect on law practice and the feature of the science of law itself.
