论法律体系的概念及其构建的一般条件——综合系统论和分析法学视角

On the Concept of the Legal System and its General Conditions of Construction: Synthesizing the Perspective of the System Theory and the Analytical School of Law

从系统论关于系统构成所需具备的特性的视角看法律体系,法律体系不仅是一个静态的逻辑体系,也是能动态运作并发挥功能的有机系统。而这种对法律体系的认识,其实也包含在分析法学各代表学者的论述中。由此,从综合系统论和分析法学视角看法律体系,则法律体系是一个开放的复杂巨系统。法律体系的构建因而在做内部自我静态结构的文本完善的同时,也要保持一个开放的视角,需要从文本拓展到实践,从法律内部拓展到法律外部。

Accordingly, synthesizing the perspective of the system theory and the analytical school of law, we should take for the legal system as the open complex giant system. Consequently, we should adopt an open perspective from which We should not only consider the static text of the legal system, but also consider the dynamic structure. We should not only consider the internal structure of the legal system, but also consider its external environment.
