论船舶买卖中船舶所有权的归属——兼评最高人民法院《买卖合同纠纷司法解释》第10条 被引量:1

摘要 2012年最高法院出台的《关于审理买卖合同纠纷案件适用法律问题的解释》第10条确定了特殊动产一物多卖时所有权归属的规则。其"交付优先于登记"的规定,对船舶买卖中船舶所有权的归属问题产生巨大影响。结合我国物权法、海商法、船舶登记条例等法律法规,分析我国船舶所有权变动模式、公示公信力等来研究船舶买卖中所有权的归属,可认为船舶所有权"登记优于船舶交付",不应再适用该司法解释来确定船舶买卖中船舶所有权的归属。 The Supreme People's Court enacted"Interpretation of the Supreme People's Court on Issues Concerning the Application of Law for the Trial of Cases of Disputes over Sales Contracts" in 2012. Article 10 in this interpretation established ownership rules of special movable property when it is sold for more than one time. On the basis of Property law and maritime law in our country, the paper focus on analyzing change pattern of the ownership of ship and public credibility in China, to determine the ownership of ships, and then draws the conclusion, that the regulation that the registration takes priority to payment should not use the judicial interpretation to determine the ownership of ship.
