论德育与我国法律系统危机之缓解——以诠释学对法律实际运作的揭示为视角

摘要 目前,我国法律系统的运作部分地面临着来自公众的信任危机,这种系统危机在一定程度上可归因于受到职业教育的法律职业者与社会公众在价值理念方面的分歧。按照海德格尔-加达默尔诠释学的观点,前见决定了理解者对于文本的理解向度。由于价值前见的分歧,对于同样的法律文本,我国的法律职业人基于自己的前见容易得出不能为公众所认同的理解与裁判,因而减少了获得公众认可与信任的可能性。解决该危机的一个可行之策是加强德育,在大学教育中,通过"思想道德修养与法律基础"课程培养法律人对公众伦理的尊重与认同,使他们在沟通商谈基础上形成与社会公众相一致或接近的前见。 Our current legal system's operation is partly facing crisis of confidence coming from the public in general. This kind of system crisis to some extent can be contributed to the divergence of the value idea between the legal professionals who have been professionally cultivated and the public in general. According to H-J's Hermeneutiks opinion, preconeep tion determines the understanding dimension of readers to texts. Due to the divergence of value precondition, to the same legal texts, Chinese legal professionals are liable to draw conclusions hard to be accepted by the public in general and then reduced the possibility of gaining public's acceptance and trusting. A possible solution is to strengthen ideological and mor al education to legal students to make legal professionals have the same or similar precondition with the public in general.
