页岩气勘探开发中信息公开制度之疏失与完善

The Defects and Perfections of the Information Disclosure System in the Exploration and Exploitation of Shale Gas

近几年来我国出台系列政策推动页岩气勘探开发,但页岩气勘探开发过程伴随着环境风险、技术风险与市场风险,信息公开成为了页岩气勘探开发的内在需求。我国页岩气勘探开发中政府环境信息公开存在疏漏与缺位,企业也以保护商业秘密为由拒绝公开核心技术中的化学物质成分。完善页岩气勘探开发信息公开的制度路径包括两个方面,首先应当在资源储量、地质资料和配套服务等方面完善政府信息公开的范围;其次,应当完善现行制度以强制要求油气企业公开其使用的压裂液中的化学成分。

In recent years, China introduced a series of policies to promote the exploration and exploitation of shale gas. But there are environmental risk, technical risk and market risk in the process of the exploration and exploitation of shale gas. Information disclosure has become the internal demand of exploration and exploitation of shale gas. Since there is no clear legal system, the companies refused to disclose the chemicals in the fracturing fluids in order to protect the commercial secrets. The path to improve the information disclo- sure system of the exploration and exploitation of shale gas includes two aspects. First of all, we should perfect the scope of government information disclosure on resource reserves, geological data and supporting services etc. Secondly, we should improve the current sys- tem to demand oil and gas companies to disclose the chemical composition of their fracturing fluid.
