有关个人信息保护立法之思考

On the Construction of Legal System for Personal Information Protection

信息时代中个人信息的使用、规制逐渐走入法律的视野。这不仅是信息化大趋势和社会和谐发展的必然要求,更是中国法制健全不可分割的一部分。然而由于我国社会观念、发展进度以及相关技术的局限,我国目前没有专门法来保护个人信息,在个人的合法权益受到不法侵害时得不到有效的救济,同时信息亦未能被最大程度地加以利用,从而推动社会经济的发展。关于个人信息的法律保护,我国应结合具体国情,借鉴欧、美、日模式,尽快出台个人信息保护法,并建立专门针对个人信息保护执法的监督机构。

In the information age, the use and regulation of personal information gradually enters into the legal vi- sion,which is not only the inevitable requirement of informatization trend and harmonious social development, but also the inalienable part of China＇s legal system. But because of the limitation of social ideas, the development progress and the re- lated technology, there is no special law to protect personal information, resulting in the fact that there is no effective reme- dy when the legitimate rights and interests are illegally infringed,and the information cannot be used to promote the develop- ment of social economy. Experts and scholars have made a lot of research and attained some achievements about the legal protection of personal information. The legislation also made a positive response, but there are still many obscure regula- tions. With the right attribute of personal information as the breakthrough, some contrary point of view is solved to provide a solid theoretical basis for the legal protection of personal information. The personal information protection law should be made, and the supervision institution should be established.
