摘要
对消费者权益施以保护,是现代反垄断法所体现的精神内核之一。许多国家和地区在反垄断立法和司法实践过程中都将消费者权益纳入保护范围,对其高度重视并加以落实。我国《反垄断法》亦明确作出规定,将维护消费者权益作为该法的立法宗旨和目的之一,其重要性不言而喻。但不可忽视的是,我国反垄断法在法律条文中存在不少模糊、笼统的规定,这对消费者权益的有效保护极为不利。因此,文章从消费者定位出发,从我国反垄断法对消费者权益保护的现状、缺陷以及完善等方面分别予以总结和分析。
To protect the consumer rights is one of the spiritual cores of modern Antitrust Law. Consumer protection is included in the anti-monopoly legislation and judicial practice process in many countries and regions, which is attached great importance to its implementation.China's "Antitrust Law" also clearly provides that the consumer protection is one of the legislative aims and purposes of the act, whose importance is self-evident.But that can not be ignored is that there are many vague and general provisions in China's Antitrust Law, which is extremely unfavorable for effective consumer protection. Therefore, the article started from positioning the consumer,summarized and analyzed the status quo,defects and improvement of consumer protection by China's Antitrust Law.
