摘要 现阶段,餐饮企业大气污染导致的居民投诉居高不下,已成为影响社会和谐稳定的重要因素。究其原因,餐饮企业工商注册登记是否需要环评审批前置在立法上不明确,环保部门、工商部门和法院对于该问题的态度截然不同,导致法律适用上的混乱,也无法从根本上解决餐饮企业大气污染问题。在《大气污染防治法》修订之际,将环评审批作为餐饮企业取得工商注册登记的前置条件具有必要性和可行性,也具有现行法上的法律依据,应当尽快在立法上加以明确,以从根本上解决餐饮企业大气污染问题。 At present, atmospheric pollution caused by catering enterprises has incurred complaints from residents and become an important factor affecting social harmony and stability. And its reason is approval of the EIA before registration in catering industry is not clear in legislation. The environmental protection department, the department of industry and commerce and the court hold different attitudes resulting in confusion on the application of the law. On the occasion of the "air pollution prevention and control law" being revised, it is necessary and feasible to involve the EIA approval lead procedure towards catering enterprises. And we should make it clear in the legislation in order to solve the problem of atmospheric pollution in catering enterprises fundamentally.
