摘要
我国《仲裁法》对商事仲裁员任职资格问题的立法缺陷主要是:对商事仲裁员任职资格采用严格任职资格制度;未赋予商事仲裁当事人决定商事仲裁员任职资格的权利;采用商事仲裁员强制名册制度;对外国人担任商事仲裁员问题规定不明确,并剥夺了现任法官担任商事仲裁员的资格。解决我国《仲裁法》上述立法缺陷的最有效做法是对《仲裁法》进行修改和完善,即:只要具备完全行为能力且不存在不能担任商事仲裁员情形的任何自然人均有担任商事仲裁员的资格;明确赋予当事人具有决定商事仲裁员任职资格的权利;改商事仲裁员强制性名册制度为商事仲裁员推荐名册制度;允许外国人在国内商事仲裁中担任商事仲裁员,解除对现任法官担任商事仲裁员的立法限制。
About qualification of commercial arbitrator in China Arbitration Law, problems are mainly: using strict qualification system; parties have no right to decide commercial arbitrator qualification; using mandatory register system; no explicit provision on foreigner acting as commercial arbitrator, also depriving the incumbent judge of commercial arbitrators qualification. The most effective way to solve these problems is to modify and improve it, that is: anyone who has capacity, and the situation is allowed, he could act as a commercial arbitrator; expressly granted the parties have the right to decide commercial arbitrator qualification; change mandatory register system to recommend register system; allow foreigners to be commercial arbitrators in the domestic commercial arbitration, remove the restrictions on incumbent judge served as commercial arbitrator
