我国文物法律保护公众参与制度构建路径的思考

Study on the Way of Constructing the Nationwide Participation System on Legal Protection of Cultural Relics in China

文物保护事业是一项全民参与的事业,然而,我国的文物保护事业由政府主导,公众作用难以发挥。我国应当借鉴其他国家或地区的经验,构建并完善我国文物保护的公众参与制度。具体措施包括:设置社区、民间团体和企业多元主体参与模式,构建公众参与的权利保障机制,引入文物保护公益诉讼制度。

Cultural heritage protection is a career of the nationwide participation. However, the career is almost dominated by the government, and the role of the public is difficult to play. China should learn from the experience of other countries to improve current the public participation in herit- age conservation system. Some strategies are put forward as follows, constructing community, non- governmental organizations and enterprises etc. multi subject participation model, establishing right protection mechanism for the nationwide participation, introducing public interest litigation system, and so on.
