摘要 《消费者权益保护法》中关于经营者一般性告知义务的规定难以为司法机关确定各行业各契约中经营者具体告知义务的内容提供有效指导。就家用汽车买卖而言,能明确划定经营者告知义务的合理边界。对于新车,经营者应当告知消费者汽车的基本情况、瑕疵和缺陷信息以及售后服务情况等。二手车买卖中,经营者应尽更严苛的信息告知义务。经营者免于告知的事项包括商业秘密、与个人意见有关的信息、与影响汽车行业的市场环境有关的外在事实以及消费者可自行修得的众所周知的事实等。 The provisions about the general obligation to inform the operator of each contract in Consumer Protection Act is difficult for the judiciary to provide effective guidance in determining the various sectors of the specific content of the obligations. As for the sale of the family car, on the basis of the relevant legal texts and summary of judicial experience, operators can clearly delineate the obligation of reasonable boundaries. For the new car, the seller shall notify the buyer the basic situation of vehicles, flaws and defects and service information and so on. For used car sale, the seller shall strictly undertake the obligation of notification. The matters which exempt from notification include trade secrets, information related to personal opinions, matters influencing the external market environment of automotive industry as well as the well-known fact that consumers can achieve by themselves.
