藏族借贷习惯法现代化转型:动因、困境与路径

The Research of Modernization and Transformation of Tibetan Borrowing Customary Law:Impetus,Obstacles and Ways

藏族借贷习惯法是藏族习惯法的重要组成部分,与藏民的日常生活密切相关,在维护藏族社会秩序方面起到了重要作用。由于藏区的对外开放及法制的深入推进,藏族传统的借贷习惯法与现代法制出现了一些脱节和断裂,同时由于藏族地区社会主义法治建设、经济发展和现代化转型及社会和谐维护的需要,藏族借贷习惯法的现代化转型迫在眉睫。本文分析了藏族借贷习惯法现代化转型的动因、困境,并提出了适合中国国情的藏族借贷习惯法现代化转型路径。

Tibetan borrowing customary law is closely related to the daily life of Tibetan, and played an important role in the maintenance of social order in Tibet. But the borrowing customary law has many conflicts with national legal system. In order to meet the demands of Tibetan area economic development, modernization transformation and maintenance of the Tibetan harmony, it is imminent for modernization of Tibetan ben＇owing eustonuu＇y law. So this article tries to discuss a path of modernization and transformation which suit to the mode of Chinese development.
