Analysis of Pledge of Intellectual Property Right in China

知识产权质押属于权利质押的一种,对于解决我国小微企业特别是科技型小微企业融资难问题具有重要意义。但是并非所有的知识产权都可以作为权利质押的标的。我国立法对于知识产权质押制度的规定不够完善,在实际运行过程中,存在不少问题。针对现实问题,结合知识产权的特殊性,完善知识产权质押制度成为必要。

Pledge of intellectual PROPERTY rights is a type of pledge of rights, It is of great importance to the resolution of difficulty of financing for Chinese small and micro businesses especially the scientific and technologic type of small and micro businesses. However, not all kinds of intellectual property rights could be the object of pledge of rights. There is still much room to improve in the regulation of pledge of intellectual property rights of China. Many problems can be found during the actual implementation of pledge of intellectual property rights. It is necessary to reinforce the system of pledge of intellectual property rights based on the analysis on particularity of in- tellectual property with respect to the real issues.
