怎样编纂一个民法典与编纂一个怎样的民法典同等重要,新时代的民法典有赖于体现新时代特质的形成机制。在我国民法典编纂中,立法关注在集中于民法典体例与内容的同时,还应当兼顾民法典形成机制的建构与完善。一个能够产生划时代民法典的形成机制,应当能够充分运用时代提供的立法资源、知识能力与技术可能,做到兼顾民法典的技术完善与理念彰扬,有效地整合学界通说并精准地合成社会共识,同时能够处理好立法与改革的关系。

The question of how to codify the civil law is as important as the question of what kind of civil code should be formulated. The adoption of a civil code in the new era depends on a codification mechanism that embodies the characteristics of the new era. During the codification of the civil law in China, attention should be paid not only to the style, layout and the content of the code, but also to the construction and improvement of the codification mechanism. A civil codification mechanism that can produce an epoch-making civil code should be able to fully utilize the legislative resources, knowledge capabilities and technical possibilities available in the new era, attach equal importance to the improvement of legislative techniques and the embodiment of ideas, effective integrate generally accepted theories into accurate social consensus and, at the same time, properly deal with the relationship between legislation and reform.
