社会生态视角下司法效益管理机制构建

On the Construction of Judicial Efficiency Management Mechanism in Perspective of Social Ecology

本文从理论和实践两个层面系统研究了司法效益管理机制的构建过程,揭示了司法效益管理与社会生态平衡良性循环的作用机理,进一步奠定了司法效益管理机制得以成立的基石,找到了司法效益管理得以确立的支撑,打开了以司法效益管理推进社会生态平衡的内核,在司法效益管理与社会生态平衡之间架起了宽阔的桥梁,把司法效益从结果追求的静态模式推进到过程控制的动态模式,从表面的司法程序设置推进到深层次司法心理调控,为司法机关在全面推进依法治国背景下构建法治理论体系和提高法治能力提供了理论引领和实践路径。

This article systematically studies the construction process of judicial efficiency management mechanism in theo- ry and practice, reveals the mechanism of the virtuous cycle in judicial efficiency management and social eco logical balance, deeply researches the cornerstone and finds the support of judicial efficiency management to be set up, opens the inner core of the judicial efficiency management in promoting the social ecological balance, sets up a wide bridge between judicial efficiency management and social ecological balance, realizes the judicial efficiency from the static result - pursuing mode to dynamic process - controlling mode and from the external ju dicial procedure settings to the internal judicial pcychological regulation. All this can provide theoretical and practical paths for judicial organs to construct legal theory system and promote the ability of the rule of law in the context of comprehensively promoting the rule of law.
