新闻自由是民主赖以生存的根本。与此同时,各个国家都有涉及国家安全和利益的信息被列为国家秘密而不对公众披露的情况。崇尚新闻自由的理念与保守国家秘密的需要发生冲突在所难免。"斯诺登事件"将这一冲突推向高潮。美国和英国政府对"斯诺登事件"的不同处理态度,源于不同的法制传统,体现了政府和媒体之间的博弈。这对我国正在进行的新闻立法有重要的启示。
Freedom of the press forms a substructure of modern democratic politics. At the same time, every country has some information related to nation safety and benefits which are kept as state secrets and unknown to the public. The conflict between advocating freedom of the press and keeping state secrets is inevitable. The Snowden incident brings the conflict to a climax. The different attitudes between the U. S.A. and the G. B. to Snowden incident root from the different legal tradi- tion, and show the game between media and government, which also has important implications for the current news legislation of our country.
