Public Opinion Guide to Criminal Policy Constructing

民意在刑事政策的制定中具有重要的导向作用,还有助于形成遏制犯罪的社会力量,将民意导向引入刑事政策中,可以树立民众对法律的信仰,从而促进刑事政策的有效落实。然而民意具有不稳定性和随意性的特点,其非理性因素对刑事政策具有反向作用,因此民意的刑事政策化过程中应该引入理性民意,引导非理性民意,而在实施过程中则要保持刑事政策的独立性,弱化民意的干涉。

The public opinion has played an important role in formulation of criminal policies. It may form a social force against to crimes. So, if it is introduced to criminal policies, public opinion guidance can help build up the people＇s trust of laws and thus promote effective implementation of the criminal policies. However, the public opinions may be random and instable, their non-rational factors have negative effects on the criminal policy. Therefore, introduction of the public opinion to the criminal policy constructing should give priority to rational opinions for any guidance to the non-rational ones. In the process of implementation, the criminal policy should maintain its independence weakening the imerference of public opinions.
