法官定案决策行为变异现象探究

Variations in Judges' Verdict Decision Behaviors

受司法组织机制、法官身份角色等多重因素的影响,司法实践中法官在案件决策过程中的行为有时会呈现出积极追求、消极让渡、随性干扰案件决策权等非常态现象,对案件程序公正、实体公正和司法公信产生了一定的负面作用。对此,在立足于案件决策过程的基础上,需要关注法官的人性需求,从审判权运行的客观规律入手,完善定案决策机制,规范和引导法官的定案决策行为。

In the judicial practice, influenced by factors of judicial mechanism and judges＇ roles, judges will display abnormal phenomenons like active pursuit of verdict decision, negative transference of it, and optional interference of it, which have caused harms to procedural justice, entity justice and public confidence in justice. Therefore, it is necessary to pay much attention to both principles of the decision-maklng process and judges＇ common needs. We must study and make use of objective laws of justice, so as to improve the verdict decision mechanism and guide and standardize the judges＇ verdict decision behavior.
