我国《人体器官移植条例》的修改完善

On Modification of China's Human Organ Transplantation Regulations

《人体器官移植条例》是适应我国器官捐献移植工作的需要而出台的一部行政法规,是目前而言我国效力层次最高的器官移植法,其出台将我国器官移植工作纳入了法治化的轨道,成为我国器官移植立法史上是一个具有里程碑式的事件。但伴随着我国器官捐献移植工作新形势的出现,该《条例》已经面临诸多挑战,与我国器官捐献移植的现实需要不相适应。为此,需要及时对该《条例》进行相应的修改,以推动我国器官移植的进一步发展。

The China’s Human Organ Transplantation Regulations is an administrative law for the organ transplantation in China’s with the highest legal effect. It regulated the organ transplantation in law and be-came a milestone in the history of organ transplantation in China. Yet with new situations occurring in organ transplantation, this regulation has faced to many challenges, which was not adapted to the need of the reality. Therefore, we needed to modify the Regulation in time to improve the development of the organ transplantation in China.
