The Australian Experience of Regulating Administrative Monopoly and Its Implication to China——Analysis from the Angle of National Competition Policy

摘要行政性垄断即政府限制竞争行为,其对经济和政治危害严重,应该受到规制。澳大利亚的模式在遏制行政性垄断方面最为系统和有效,尤其是其中的竞争审查制度已经成为各国仿效的典范。我国应借鉴澳大利亚的模式,寻求高层充分重视,施行"国家竞争政策",引入竞争评估机制,设立独立执行机构,以解决目前行政性垄断规制不力的难题。 Administrative monopolies, which by nature are restrictions ot compennon Dy government, harm both the economy and politics seriously, and hence should be well regu- lated. However the current regulation in China is weak. Highlighted by its mechanism of competition assessment and followed by many countries, the Australian model is the most systematic and efficient one in the world. Based on Australian experience, this paper holds that China should seek high level political support, establish its National Competition Poli- cy, introduce the mechanism of competition assessment and set up an independent enforce- ment agency.
