死刑,乃是最严厉之刑罚方法,有着远久的历史渊源与漫长的演进过程。在多方面原因催化下,死刑正面临着被废除的前景,而这一废除的整体趋势正在世界范围内迅速蔓延。时至今日,全球废除死刑之国家已过大半,而各种国际公约的签订及国际人权组织的推动,让死刑的彻底废除变得更为现实。以实际资料为依据,较为详细地整理死刑的各国立法、司法实践,进而对我国死刑废除作理性展望,以期对此议题的深入探讨有所裨益。

Capital punishment is the severest penalty with a long historical origin and evolution. For many reasons,capital punishment is faced with the prospect of being abolished,and such a trend is rapidly sprea- ding worldwide. Now, the global abolition of capital punishment has been popular, and the promotion of in- ternational convention and international human rights organizations makes the abolition more realistic. Based on the actual data and a detailed arrangement of the capital punishment legislation and judicial prac- tice in many countries, this paper then makes a rational outlook on the abolition of capital punishment in China so as to do good to the discussion of this topic.
